These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and roadcarry, doing business as DailyAttic ("Company," "we," "us," or "our"), governing your access to and use of the DailyAttic mobile application (the "App") and any related services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.
We reserve the right to modify these Terms at any time. We will notify you of changes at least seven (7) days before they become effective. However, changes relating to new functionality, security updates, bug fixes, or court orders may take effect immediately upon notification. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
The Services are intended for users who are at least 18 years of age. By using the Services, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use or register for the Services.
To use certain features of the Services, you must register for an account. You may register using your Google or Facebook account. You agree to:

DailyAttic provides AI-generated content briefings and audio content delivered through the App. All content provided through the Services is digital in nature and intended for your personal, non-commercial use only.
We offer a seven (7) day free trial for new users. At the end of the free trial period, your account will be automatically charged according to your chosen subscription plan unless you cancel before the trial period ends.
The Services are offered on a subscription basis. You may choose between monthly and annual subscription plans. All subscriptions automatically renew at the end of each billing period unless canceled prior to renewal.
All payments are processed through in-app purchases via the Apple App Store or Google Play Store. Prices are denominated in US dollars and are subject to change. Any price changes will be communicated in advance in accordance with app store policies.
You may cancel your subscription at any time through your Apple App Store or Google Play Store subscription settings. Cancellation will take effect at the end of the current billing period. No partial refunds will be issued for unused portions of a subscription period.
Due to the digital nature of our content, all sales are final. Refund requests are handled in accordance with the applicable app store's refund policies (Apple App Store or Google Play Store).
You agree not to engage in any of the following activities:
Violation of these prohibitions may result in immediate suspension or termination of your account.
The Services, including but not limited to the App, its design, features, and AI-generated content, are owned by or licensed to DailyAttic and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal purposes in accordance with these Terms.
Content sourced from public domain works remains in the public domain. However, AI-generated briefings, summaries, audio, and other derivative content produced by DailyAttic are proprietary to DailyAttic.
The Services may contain links to third-party websites or services that are not owned or controlled by DailyAttic. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that DailyAttic shall not be liable for any damage or loss caused by your use of any such third-party websites or services.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate, reliable, or complete.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAILYATTIC, ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DAILYATTIC DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless DailyAttic and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or your violation of these Terms.
Before initiating any formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at roadcarrycom@gmail.com. The parties shall use good faith efforts to resolve the dispute within thirty (30) days of notification.
If the dispute cannot be resolved through informal negotiations, it shall be submitted to binding arbitration in Seoul, South Korea. The arbitration shall be conducted in English by a single arbitrator. The arbitrator's decision shall be final and binding on both parties.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
We may terminate or suspend your account and access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DailyAttic regarding the use of the Services and supersede all prior agreements and understandings.
